Clinical Nutrition Terms & Conditions

These Terms & Conditions apply specifically to Clinical Nutrition services provided by Kaya Colonics & Wellness Centre and should be read together with Kaya’s General Terms & Conditions, Privacy Policy, applicable booking policies and any nutrition consultation information provided to the client.
- Service Eligibility
Clients must be at least 18 years of age to independently book and participate in a Clinical Nutrition consultation. Kaya may, at its discretion and subject to suitability, accept a client aged 16–17 years where written consent from a parent or legal guardian has been provided and the client is accompanied by a parent, legal guardian or responsible adult.
Kaya reserves the right to assess whether its Clinical Nutrition service is appropriate for an individual client and may recommend that the client seek care from, or continue care with, a GP, medical specialist, Accredited Practising Dietitian or other appropriately qualified healthcare professional where the client’s needs fall outside the scope of the service.
- Health Information & Client Disclosure
Clients must provide complete, accurate and current information relevant to the consultation, including medical history, diagnosed conditions, medications, supplements, allergies and intolerances, pregnancy or breastfeeding status, pathology results where relevant, dietary practices, symptoms and other information reasonably required to assess nutritional needs and suitability.
Clients must inform the practitioner of any relevant change to their health, medications, supplements, pregnancy status, diagnosis, treatment plan or other circumstances before future consultations.
Kaya relies on the information supplied by the client. Incomplete or inaccurate disclosure may affect the appropriateness of nutrition recommendations and may result in a consultation being modified, postponed or discontinued.
- Nature and Scope of Clinical Nutrition
Clinical Nutrition consultations may include assessment of dietary intake, lifestyle factors, health history, symptoms and nutritional needs, together with personalised nutrition education and recommendations within the practitioner’s professional scope.
Recommendations may include dietary and lifestyle strategies and, where appropriate and within professional scope, discussion of nutritional supplements or further assessment. Recommendations are individualised and may change as new information becomes available or the client’s circumstances change.
Clinical Nutrition at Kaya is complementary healthcare and does not replace medical diagnosis, emergency care or treatment by a registered medical practitioner. Clients should continue prescribed medical treatment and should not stop or alter prescribed medication on the basis of nutrition advice without consulting the prescribing healthcare professional.
- Referrals, Pathology & Other Healthcare Providers
Where appropriate, the practitioner may recommend that a client consult their GP, medical specialist, pharmacist, Accredited Practising Dietitian or another appropriately qualified healthcare professional.
Where pathology testing, medical investigation or medical clearance is considered appropriate, the client may be advised to discuss this with their GP or other relevant healthcare professional. Kaya does not diagnose disease or provide medical clearance.
Clients are responsible for arranging and paying for any external medical consultations, pathology testing, investigations, products or services unless Kaya expressly states otherwise.
- Nutrition Recommendations, Supplements & Client Choice
Nutrition recommendations are based on the information available at the time of consultation and the practitioner’s professional assessment within scope. Individual responses vary.
Where nutritional supplements are discussed or recommended, clients must disclose relevant medications, supplements, allergies, pregnancy or breastfeeding status and health conditions. Clients should seek advice from their GP or pharmacist where there is any concern about interactions, contraindications or suitability.
The client remains responsible for deciding whether to follow dietary, lifestyle or supplement recommendations. Kaya does not guarantee that any recommendation, product or program will produce a particular result.
- Pricing, Deposit & Payment
Current consultation prices are displayed on Kaya’s website, Fresha booking page or quoted at the time of booking.
A 70% non-refundable deposit is required at the time of booking to secure an appointment. The remaining 30% balance must be paid prior to or at the commencement of the scheduled appointment.
Where a client reschedules in accordance with Kaya’s Cancellation, Rescheduling & No-Shows Policy below, the deposit may be transferred as a credit to the rescheduled appointment. Payments may be accepted by credit/debit card, cash, eligible Kaya gift cards, pre-paid packages or other approved payment methods. Any applicable card surcharge or payment fee will be disclosed.
Nothing in this section limits any rights or remedies available under the Australian Consumer Law.
- Cancellation, Rescheduling, Late Arrival & No-Shows
Kaya understands that appointments may occasionally need to be changed. As consultation times are reserved specifically for each client, the following conditions apply.
Rescheduling with at least 24 hours’ notice: An appointment may be rescheduled at no additional charge. The existing 70% deposit will be transferred as a credit to the rescheduled appointment.
Rescheduling with less than 24 hours’ notice: The existing deposit will be forfeited and a new deposit will be required to secure another appointment.
Late Arrival: Clients are responsible for arriving on time. A late arrival may result in a shortened consultation to avoid delaying subsequent appointments. The full consultation fee will still apply.
If a client arrives 30 minutes or more after the scheduled appointment time, Kaya may be unable to provide the consultation. The appointment may be treated as a late cancellation/no-show, the 70% deposit forfeited, and a new deposit required to secure another appointment.
Cancellation: Deposits are non-refundable. Where sufficient notice is provided, Kaya may, at its discretion, allow the deposit to be transferred as a credit toward another eligible service or future appointment.
Cancellation within 6 hours or failure to attend: The deposit will be forfeited. Kaya may also charge the remaining 30% balance of the consultation fee, to the extent permitted by law.
Nothing in this section excludes, restricts or modifies any refund, remedy, consumer guarantee or other right that cannot lawfully be excluded under the Australian Consumer Law.
- Clinical Nutrition & Colonic Duo
Where Clinical Nutrition is booked as part of a combined Clinical Nutrition & Colon Hydrotherapy service, each component remains subject to its applicable service-specific Terms & Conditions, health screening, suitability requirements and consent.
Suitability for one component does not automatically establish suitability for the other. Kaya may modify, postpone or decline either component where reasonably necessary for health, safety, suitability or informed-consent reasons. Any Colon Hydrotherapy component is also subject to Kaya’s Colon Hydrotherapy Terms & Conditions.
- Professional Conduct & Consultation Boundaries
Kaya is committed to maintaining a safe, respectful and professional environment for clients, practitioners and staff. Threatening, abusive, discriminatory, harassing, intimidating, sexualised or otherwise inappropriate behaviour will not be tolerated.
A practitioner may end a consultation and, where appropriate, ask a client to leave if professional boundaries are breached, consent is withdrawn, reasonable health or safety directions are not followed, or continuing the appointment would compromise safety, wellbeing or the professional consultation environment. Where a consultation is ended because of inappropriate client conduct, the consultation fee may be retained or charged to the extent permitted by law.
- Right to Refuse, Modify, Postpone or Discontinue a Service
Kaya Colonics & Wellness Centre reserves the right to refuse, modify, postpone or discontinue a Clinical Nutrition service where reasonably necessary for health, safety, suitability, informed consent, professional boundaries or conduct reasons, or where the client’s needs are outside the practitioner’s professional scope.
Where reasonably practicable, Kaya will explain why the service is being modified, postponed, discontinued or refused and may recommend referral to another appropriate healthcare professional.
This clause does not give Kaya an unrestricted right to discriminate or refuse a service on a basis prohibited by law. Decisions will be made consistently with applicable NSW and Commonwealth law.
Where Kaya cannot provide a booked service for reasons attributable to Kaya rather than the client’s suitability, conduct or breach of these Terms & Conditions, any applicable refund or other remedy will be provided as required by law.
- Results & Limitations
Individual responses to nutrition and lifestyle changes vary. Outcomes may be influenced by health conditions, medications, adherence, lifestyle, genetics and other factors outside Kaya’s control.
Kaya does not guarantee any particular weight-loss, digestive, metabolic, therapeutic, cosmetic or other health outcome from Clinical Nutrition consultations, dietary changes, lifestyle recommendations or supplements.
Clients experiencing new, severe, persistent or concerning symptoms should seek appropriate medical assessment rather than relying solely on nutrition advice.
- Privacy & Confidentiality
Client information, including health, dietary and contact information, will be handled confidentially and in accordance with applicable privacy requirements and Kaya’s Privacy Policy.
Where a client asks Kaya to communicate with another healthcare provider, appropriate consent may be required before relevant information is shared, except where disclosure is otherwise permitted or required by law.
- Packages, Gift Cards & Refunds
Any Clinical Nutrition package is personal to the client and is non-transferable unless Kaya agrees otherwise. Pre-purchased packages are non-refundable to the extent permitted by law.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.
- Client Responsibility, Acknowledgement & Liability
Kaya Colonics & Wellness Centre relies on the information provided by the client when assessing nutritional needs and providing Clinical Nutrition services. Clients are responsible for providing complete, accurate and current information and for notifying Kaya of relevant changes.
The client acknowledges that nutrition recommendations are personalised professional recommendations based on information available at the time and that individual responses vary.
To the extent permitted by law, the client releases and holds harmless Kaya Colonics & Wellness Centre, its owners, practitioners, employees and contractors from claims, loss, damage, injury, costs or expenses arising from:
the client’s failure to disclose, or inaccurate disclosure of, relevant health information, diagnoses, medications, supplements, allergies, pregnancy or breastfeeding status or other circumstances relevant to the consultation;
the client’s failure to follow reasonable practitioner instructions or to seek recommended medical assessment or advice;
the client’s alteration or cessation of prescribed medication or medical treatment without consulting the prescribing healthcare professional; or
ordinary and reasonably foreseeable effects associated with dietary, lifestyle or supplement changes that occur despite recommendations being provided with appropriate care and skill.
The client acknowledges that no specific therapeutic, digestive, metabolic, weight-loss or other health outcome has been promised or guaranteed and that individual results may vary.
This release does not apply to the extent that any loss, damage or injury is caused or contributed to by the negligence, breach of duty, unlawful conduct or other fault of Kaya Colonics & Wellness Centre or its practitioners, employees or contractors.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
- Changes to These Terms
Kaya Colonics & Wellness Centre may update these Terms & Conditions from time to time. The terms made available to the client in connection with the booking will apply, subject to applicable law.
- Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
- Client Consent & Declaration
By booking and/or proceeding with a Clinical Nutrition consultation, I confirm that I have read and understood these Terms & Conditions, have provided complete and accurate health, medication, supplement and dietary information, and consent to the consultation.
I understand that Clinical Nutrition does not replace medical diagnosis or treatment, that I should not stop or alter prescribed medication without consulting the prescribing healthcare professional, and that individual outcomes cannot be guaranteed.
I also understand that Kaya Colonics & Wellness Centre may refuse, modify, postpone or discontinue a service where reasonably necessary for health, safety, suitability, informed consent, professional-boundary, scope-of-practice or conduct reasons, subject to applicable law.
- Duty to Notify
I agree to notify Kaya Colonics & Wellness Centre of any relevant change to my health, diagnoses, medications, supplements, allergies, pregnancy or breastfeeding status, medical treatment or other circumstances before each future Clinical Nutrition appointment, as these changes may affect the appropriateness of nutrition recommendations.
