Skin Therapy Terms & Conditions

Skin Hydration & Microneedling

These Terms & Conditions apply specifically to Skin Therapy provided by Kaya Colonics & Wellness Centre, including Skin Hydration treatments and Microneedling, and should be read together with Kaya’s General Terms & Conditions, Privacy Policy, applicable booking policies and before- and after-care information.

  1. Service Eligibility

Clients must be at least 18 years of age to independently book and undergo Skin Therapy. Kaya may, at its discretion and subject to treatment suitability, accept a client aged 16–17 years where written consent from a parent or legal guardian has been provided and the client is accompanied by a parent, legal guardian or responsible adult.

Kaya reserves the right to assess whether a Skin Hydration or Microneedling treatment is appropriate for an individual client following consultation, skin assessment and relevant health screening. Treatment may be modified, postponed or declined where appropriate for health, safety, skin condition, suitability, informed-consent or professional-boundary reasons.

  1. Health Disclosure & Skin Suitability

Clients must provide complete, accurate and current information relevant to treatment suitability, including medical history, medications, allergies, pregnancy or breastfeeding status, skin conditions, recent illness, injury, surgery, cosmetic procedures, laser or peel treatments, and the use of prescription or topical skin products.

Skin Therapy may not be suitable for every client. Where a practitioner identifies a contraindication, active skin concern, health or safety issue, or considers that treatment may not be appropriate, Kaya may modify, postpone, discontinue or refuse treatment. Kaya may recommend or require advice or written clearance from an appropriate registered healthcare professional before proceeding.

Failure to disclose relevant information, or providing incomplete or inaccurate information, may result in the appointment being cancelled or treatment being discontinued. Clients must notify Kaya of relevant health, medication or skin changes before each future appointment.

  1. Microneedling Contraindications & Medical Considerations

Microneedling is not suitable in certain circumstances. The practitioner will assess the client’s skin and relevant health history before treatment.

Treatment may not be suitable where the client has:

  • Active acne, infection or inflamed skin
  • Open wounds or unhealed skin
  • Cold sores (herpes simplex) in the treatment area
  • A history or tendency toward keloid scarring or poor wound healing
  • Skin cancer or suspicious skin lesions in or near the treatment area
  • A blood-clotting disorder

Additional care, postponement or medical clearance may be required where the client:

  • Is pregnant or breastfeeding
  • Has recently used isotretinoin, including within the previous 6–12 months
  • Has diabetes or an autoimmune condition
  • Has highly sensitive or reactive skin
  • Has recently undergone laser treatment, chemical peels or other advanced skin procedures
  • Uses retinoids, steroids, blood-thinning medication or other medication relevant to skin healing or bleeding risk

Where there is uncertainty regarding a client’s health, medication, skin condition or suitability for Microneedling, the client should consult their GP, dermatologist or other relevant registered healthcare professional before proceeding. Kaya may require written medical clearance.

Medical clearance does not automatically guarantee that treatment will proceed. Kaya may still postpone, modify or decline Microneedling where the practitioner reasonably considers that treatment is not appropriate for the client’s skin at that time.

Some contraindications or skin concerns may be temporary. Where Microneedling is not suitable at the time of the appointment, Kaya may recommend an alternative Skin Hydration treatment or reconsider Microneedling once the relevant condition has resolved or stabilised.

  1. Nature of Skin Hydration Treatment & Consent

Skin Hydration treatments are non-invasive skin therapies intended to cleanse, hydrate and support the appearance and condition of the skin. The products, techniques and treatment steps used may be adjusted according to the client’s skin presentation, sensitivities and treatment goals.

The practitioner will explain the proposed treatment and may modify or omit products, devices or treatment steps where reasonably necessary for comfort, suitability or skin safety. Individual responses vary and no particular cosmetic or skin outcome is guaranteed.

Consent is ongoing throughout the appointment. Clients may ask questions, request a modification or ask for the treatment to stop at any time. If a client chooses to terminate a session after treatment has commenced, the applicable treatment fee may still be charged, subject to the Australian Consumer Law.

  1. 5. Nature of Microneedling & Consent

Microneedling is a skin treatment that uses a device containing fine sterile needles to create controlled micro-channels in the skin. The treatment is intended to support skin renewal and improve the appearance of the skin; individual responses and results vary.

The practitioner will assess the treatment area and select treatment settings according to the client’s skin presentation, treatment area and suitability. The client may experience temporary discomfort, warmth, redness or sensitivity during or after treatment.

Appropriate hygiene and infection-control procedures will be followed, including the use of a sterile single-use needle cartridge where applicable.

Consent is ongoing. Clients may ask questions, request a modification or ask for the treatment to stop at any time. If a client chooses to terminate a session after treatment has commenced, the applicable treatment fee may still be charged, subject to the Australian Consumer Law.

  1. Pricing, Deposit & Payment

Current treatment prices are displayed on Kaya’s website, Fresha booking page or quoted at the time of booking.

A 70% non-refundable deposit is required at the time of booking to secure an appointment. The remaining 30% balance must be paid prior to or at the commencement of the scheduled appointment.

Where a client reschedules in accordance with Kaya’s Cancellation, Rescheduling & No-Shows Policy below, the deposit may be transferred as a credit to the rescheduled appointment. Payments may be accepted by credit/debit card, cash, eligible Kaya gift cards, pre-paid packages or other approved payment methods. Any applicable card surcharge or payment fee will be disclosed.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

  1. Cancellation, Rescheduling, Late Arrival & No-Shows

Kaya understands that appointments may occasionally need to be changed. As appointment times are reserved specifically for each client, the following conditions apply.

Rescheduling with at least 24 hours’ notice: An appointment may be rescheduled at no additional charge. The existing 70% deposit will be transferred as a credit to the rescheduled appointment.

Rescheduling with less than 24 hours’ notice: The existing deposit will be forfeited and a new deposit will be required to secure another appointment.

Late Arrival: Clients are responsible for arriving on time. If a client arrives late, the treatment time may be shortened accordingly to ensure subsequent appointments are not delayed. The full treatment fee will still apply.

If a client arrives 30 minutes or more after the scheduled appointment time, Kaya may be unable to provide the treatment. The appointment may be treated as a late cancellation/no-show, the 70% deposit forfeited, and a new deposit required to secure another appointment.

Cancellation: Deposits are non-refundable. Where sufficient notice is provided, Kaya may, at its discretion, allow the deposit to be transferred as a credit toward another eligible treatment or future appointment.

Cancellation within 6 hours or failure to attend: The deposit will be forfeited. Kaya may also charge the remaining 30% balance of the treatment fee, to the extent permitted by law.

Gift cards and pre-paid packages: Where an appointment is booked using a gift card or pre-paid package, Kaya may deduct the equivalent applicable cancellation, late-rescheduling or no-show amount from the gift card or package entitlement.

Nothing in this section excludes, restricts or modifies any refund, remedy, consumer guarantee or other right that cannot lawfully be excluded under the Australian Consumer Law.

  1. Professional Conduct & Treatment Boundaries

Kaya is committed to maintaining a safe, respectful and professional treatment environment for clients, practitioners and staff. Sexualised, threatening, abusive, discriminatory, intimidating, harassing or otherwise inappropriate behaviour will not be tolerated.

A practitioner may immediately stop treatment and, where appropriate, ask a client to leave if professional boundaries are breached, consent is withdrawn, reasonable directions are not followed, or continuing the appointment would compromise safety, wellbeing or the professional treatment environment. Where a session is ended because of inappropriate client conduct, the treatment fee may be retained or charged to the extent permitted by law.

  1. Right to Refuse, Modify, Postpone or Discontinue Treatment

Kaya Colonics & Wellness Centre reserves the right to refuse, modify, postpone or discontinue a Skin Therapy treatment where reasonably necessary to protect the health, safety, wellbeing, consent or professional boundaries of the client, practitioner, staff or other clients, or where the requested treatment is not appropriate or suitable in the circumstances.

This may include where a contraindication, active skin condition, undisclosed health issue, illness, medication concern or other health or safety concern is identified; medical advice or clearance should be obtained; the client is intoxicated or impaired; consent is withdrawn or unclear; professional boundaries are breached; reasonable health, hygiene, safety or practitioner directions are not followed; or the practitioner reasonably considers that continuing treatment may cause harm or compromise skin integrity, safety or wellbeing.

Where reasonably practicable, Kaya will explain why treatment is being modified, postponed, discontinued or refused. This clause does not give Kaya an unrestricted right to discriminate or refuse a service on a basis prohibited by law. Decisions will be made consistently with applicable NSW and Commonwealth law, including the Australian Consumer Law.

Where Kaya cannot provide a booked treatment for reasons attributable to Kaya rather than the client’s suitability, conduct or breach of these Terms & Conditions, any applicable refund or other remedy will be provided as required by law.

  1. Risks, Possible Effects & Aftercare

Individual responses to Skin Therapy vary. Skin Hydration treatments may cause temporary redness, sensitivity, tingling, dryness, irritation or a reaction to a product or ingredient, particularly in sensitive or reactive skin.

Microneedling commonly causes temporary redness, warmth, tenderness, tightness, dryness, mild swelling, pinpoint bleeding or flaking. Less common complications may include prolonged irritation, bruising, infection, changes in pigmentation, cold-sore reactivation or scarring.

Clients must follow Kaya’s reasonable before- and after-care guidance, including instructions relating to skincare products, sun exposure, makeup, exercise, heat, swimming and other skin treatments where applicable.

Clients should seek appropriate medical attention if they experience severe, persistent, worsening or otherwise concerning symptoms following treatment.

Kaya does not guarantee any particular cosmetic, anti-ageing, scar-reduction, pigmentation, hydration or other skin outcome.

  1. Privacy & Confidentiality

Client information, including health, skin and contact information, will be handled confidentially and in accordance with applicable privacy requirements and Kaya’s Privacy Policy.

  1. Packages, Gift Cards & Refunds

Any Skin Therapy package is personal to the client and is non-transferable unless Kaya agrees otherwise. Pre-purchased packages are non-refundable to the extent permitted by law.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

  1. Client Responsibility, Acknowledgement of Risk & Liability

Kaya Colonics & Wellness Centre relies on the health, medication and skin information provided by the client when assessing suitability for and providing Skin Therapy. Clients are responsible for providing complete, accurate and current information and for notifying Kaya of relevant changes before each appointment.

The client acknowledges that Skin Hydration and Microneedling can produce individual and sometimes unpredictable skin responses. While reasonable care will be taken in providing the treatment, the client acknowledges and voluntarily accepts the ordinary and reasonably foreseeable risks associated with the treatment selected.

To the extent permitted by law, the client releases and holds harmless Kaya Colonics & Wellness Centre, its owners, practitioners, employees and contractors from claims, loss, damage, injury, costs or expenses arising from:

the client’s failure to disclose, or inaccurate disclosure of, relevant health information, medications, allergies, pregnancy or breastfeeding status, skin conditions, recent procedures or other circumstances relevant to treatment suitability;

the client’s failure to follow reasonable practitioner instructions, before- or after-care guidance, health, hygiene or skin-safety directions;

ordinary and reasonably foreseeable risks or temporary effects associated with the selected Skin Therapy that occur despite the treatment being provided with appropriate care and skill; or

the client’s decision to proceed after the nature of the treatment, relevant precautions and identified risks have been explained.

The client acknowledges that no specific cosmetic, anti-ageing, scar-reduction, pigmentation, hydration or other skin outcome has been promised or guaranteed and that individual results may vary.

This release does not apply to the extent that any loss, damage or injury is caused or contributed to by the negligence, breach of duty, unlawful conduct or other fault of Kaya Colonics & Wellness Centre or its practitioners, employees or contractors.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

  1. Changes to These Terms

Kaya Colonics & Wellness Centre may update these Terms & Conditions from time to time. The terms made available to the client in connection with the booking will apply, subject to applicable law.

  1. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

  1. Client Consent & Declaration

By booking and/or proceeding with Skin Therapy, I confirm that I have read and understood these Terms & Conditions, have provided complete and accurate health, medication and skin information, understand the nature of the treatment selected, and consent to proceed.

I understand that consent is ongoing and that I may ask questions or request that the treatment be modified or stopped at any time. I also understand that Kaya Colonics & Wellness Centre may refuse, modify, postpone or discontinue treatment where reasonably necessary for health, skin safety, suitability, informed consent, professional-boundary or conduct reasons, subject to applicable law.

  1. Duty to Notify

I agree to notify Kaya Colonics & Wellness Centre of any relevant change to my health, medications, pregnancy or breastfeeding status, skin condition, recent cosmetic or medical procedures, illness, injury or other circumstances before each future appointment, as these changes may affect my suitability for Skin Hydration or Microneedling.
